Terms and Conditions

1. General Provisions

These Terms and Conditions set out the rules for using the TheCloudHero.co website, hereinafter referred to as the “Website”.

The operator of the Website and the service provider is:

hereinafter referred to as the “Service Provider”.

A “User” is any person using the Website.

These Terms and Conditions are made available free of charge in a manner that allows them to be displayed, saved and reproduced.

By starting to use the Website, the User enters into a free-of-charge agreement for the provision of electronic services under the terms set out in these Terms and Conditions.

2. Purpose and Nature of the Website

TheCloudHero.co is an educational website dedicated to Salesforce technology, professional skills development and the job market related to the Salesforce ecosystem.

The Website is intended in particular to:

  • promote knowledge about Salesforce;
  • publish educational materials, articles and information related to Salesforce;
  • support the professional development of people interested in Salesforce technology;
  • present information about professions, skills and career development opportunities within the Salesforce ecosystem;
  • increase awareness of the Salesforce job market;
  • make it easier for Users to find Salesforce-related job opportunities.

One of the functions of the Website is to present basic information about job offers obtained from publicly available sources, such as job boards, employers’ websites, career pages and other publicly available online sources.

The publication of job information is for informational purposes and is intended in particular to present employment opportunities, demand for specific skills and the situation on the Salesforce job market.

Each job offer includes a link to the source website, where the full job description, detailed requirements and application option may be available.

The Service Provider is not the employer publishing the job offers presented on the Website, an employment agency or a recruitment intermediary, unless expressly stated otherwise in relation to specific content.

The Service Provider does not conduct recruitment processes, does not accept or store CVs/resumes, does not forward applications to employers and does not make employment decisions.

Applications are submitted outside the Website, directly on the source website and in accordance with the rules established by the employer or the operator of that website.

3. Scope of Electronic Services

The Service Provider provides free electronic services consisting of:

  • making available educational materials, articles and other content related to Salesforce;
  • enabling Users to browse, search and filter job offers, where the relevant functions are available;
  • presenting basic information about job offers;
  • providing links to source websites;
  • enabling Users to contact the Service Provider by email.

The Website does not allow Users to create user accounts and does not operate a newsletter.

The Service Provider does not guarantee the availability of any specific number of job offers or materials, nor the presence of offers from any particular employer.

The Service Provider may develop, modify, restrict or remove Website features, subject to Users’ rights under applicable law.

4. Technical Requirements

To use the Website, the User must have:

  • a device with internet access;
  • an up-to-date web browser;
  • support for the technologies necessary to display the Website.

An active email address is required to contact the Service Provider.

Using outdated software may cause the Website to function or display incorrectly.

The User bears the costs of internet access in accordance with the agreement concluded with their telecommunications service provider.

5. Rules for Using the Website

The User is required to use the Website in accordance with the law, these Terms and Conditions, accepted standards of conduct and with respect for the rights of the Service Provider and other persons.

In particular, it is prohibited to:

  • provide unlawful content;
  • interfere with the operation of the Website or circumvent technical security measures;
  • attempt to gain unauthorised access to infrastructure or data;
  • distribute malicious software;
  • use the Website for fraud or other unlawful activities;
  • impersonate another person or entity;
  • excessively burden the Website with automated requests;
  • download or copy a substantial part of the Website or its database on a mass scale in breach of the law or applicable security measures;
  • use content in a way that infringes intellectual property rights.

6. Educational Materials

Materials published on the Website are educational and informational in nature.

The Service Provider exercises due care to ensure that the content is reliable and up to date; however, technologies, products, certification exams and market practices may change.

The materials do not constitute a guarantee of obtaining a certification, employment, a particular professional outcome, or individual legal, tax or business advice.

Users should verify information that requires current accuracy in official Salesforce documentation or other appropriate sources.

7. Collection and Updating of Job Offers

Information about job offers is obtained from publicly available sources.

The process of collecting, analysing, publishing, updating and removing job offers may be partially or fully automated.

Job offers are analysed on an ongoing basis; however, delays may occur in the process of collecting and updating information.

A job offer visible on the Website may have previously been changed, closed, removed, suspended or replaced with other content by the employer or the operator of the source website.

The Service Provider takes reasonable steps to keep information up to date but does not guarantee that every job offer is at all times current, complete and still available.

8. Information Presented with Job Offers

The Website may present, among other things:

  • job title;
  • employer name;
  • location;
  • working arrangement;
  • type of employment;
  • experience level;
  • basic information about the job offer;
  • date of publication or data collection;
  • source name;
  • link to the source website.

The scope of information may vary depending on the data available at the source.

Binding and complete information concerning a job offer is available on the source website.

Before submitting an application, the User should independently verify on the source website:

  • whether the job offer is still current;
  • requirements;
  • scope of responsibilities;
  • employment conditions;
  • location;
  • salary;
  • application deadline;
  • rules for processing candidates’ personal data.

9. No Participation in Recruitment

The Service Provider is not a party to recruitment processes conducted by employers or operators of source websites.

The Service Provider does not:

  • accept applications;
  • store or forward CVs/resumes;
  • assess candidates;
  • recommend candidates to employers;
  • contact candidates on behalf of employers;
  • make employment decisions.

Questions concerning a specific recruitment process should be directed to the employer or the operator of the source website.

10. Links and External Websites

The Website contains links to websites operated by third parties.

The Service Provider does not control the operation, security, accuracy, terms and conditions, privacy policies or recruitment practices of external websites.

Users should independently review the rules applicable to the source website before providing personal data or submitting an application.

The Service Provider is not a party to agreements or other relationships arising between the User and an employer, recruitment website or other third party.

11. Reliability of Job Offers and User Caution

The publication of information about a job offer does not constitute:

  • a recommendation of the employer;
  • confirmation of the employer’s reliability;
  • a guarantee that all information is accurate;
  • a guarantee of employment;
  • confirmation that any cooperation exists between the Service Provider and the employer.

Users should exercise particular caution where a job offer requires payment, asks for unusual data, directs the User to a suspicious link or promises unrealistic conditions.

Suspicious, incorrect or outdated job offers may be reported to: contact@thecloudhero.co.

12. Liability

The Service Provider exercises due care to ensure that the Website operates properly but does not guarantee uninterrupted or error-free availability.

Subject to mandatory provisions of applicable law, the Service Provider is not liable for:

  • recruitment decisions made by employers;
  • lack of response to an application;
  • content of job offers prepared by third parties;
  • delays in updates;
  • changes to or removal of a job offer;
  • actions of external websites;
  • the security of external websites;
  • interruptions resulting from failures, maintenance work or events beyond the Service Provider’s control.

Nothing in these Terms and Conditions excludes or limits liability that cannot be excluded or limited under applicable law.

13. Intellectual Property Rights

Rights to the name of the Website, its layout, graphic elements, software, original descriptions, articles and other proprietary materials belong to the Service Provider or are used on an appropriate legal basis.

Names of employers, websites, products, trademarks and other designations belong to their respective owners and are used for the purpose of identifying a job offer, employer, technology or source.

The publication of an employer’s name, a job offer or a link does not imply partnership, cooperation or endorsement.

It is prohibited to copy or reuse a substantial part of the Website or its database in violation of applicable law.

14. Reporting Job Offers and Infringements

A User, employer, operator of a source website or any other interested person may report:

  • an outdated job offer;
  • incorrect information;
  • a broken link;
  • a job offer suspected of being fraudulent;
  • an infringement of law;
  • copyright infringement;
  • trademark infringement;
  • unauthorised publication of personal data;
  • a request to correct or remove information.

Where possible, the report should include:

  • the URL of the relevant page or link to the job offer;
  • a description of the problem;
  • the requested action;
  • contact details;
  • information confirming the person’s authority to submit the request, where necessary.

The Service Provider may request additional information, temporarily hide the job offer while it is being reviewed, and after verifying the report may correct, update, label or remove the job offer.

15. Complaints

Complaints concerning the operation of electronic services may be submitted to: contact@thecloudhero.co.

A complaint should include:

  • contact details;
  • a description of the problem;
  • the date on which it occurred;
  • the URL of the relevant page;
  • the expected method of resolving the matter.

Complaints will be considered without undue delay, generally within 14 days of receiving a complete complaint.

If additional information is required to consider the complaint, the Service Provider may request that it be provided.

16. Conclusion and Termination of the Agreement

The agreement for the provision of the service consisting of making Website content available is concluded when the User starts using the Website and remains in force for the duration of such use.

The User may stop using the service at any time by leaving or closing the Website.

The Service Provider may restrict access for a User who:

  • violates the law or these Terms and Conditions;
  • threatens the security of the Website;
  • attempts to gain unauthorised access;
  • excessively burdens the infrastructure.

17. Personal Data and Cookies

The rules governing the processing of personal data are set out in the Privacy Policy available on the Website.

The Website uses, among other tools, the PostHog Cloud EU analytics service.

The rules governing the use of cookies and similar technologies are set out in a separate Cookie Policy and in the consent management panel.

18. Technical Interruptions

The Service Provider may temporarily restrict access to the Website in order to:

  • perform maintenance;
  • carry out updates;
  • fix failures;
  • improve security;
  • develop the Website.

Access may also be restricted for reasons beyond the Service Provider’s control, including failures of infrastructure providers, telecommunications networks or force majeure events.

19. Changes to the Terms and Conditions

The Service Provider may amend these Terms and Conditions in the event of changes to:

  • applicable law;
  • Website functionality;
  • scope of services;
  • technical solutions;
  • service providers;
  • security requirements;
  • the need to clarify existing provisions.

The current version of the Terms and Conditions is published on the Website together with its effective date.

Because use of the Website does not require an account and takes place on an individual-use basis, the amended Terms and Conditions apply to use of the Website after they have been published.

20. Final Provisions

These Terms and Conditions are governed by Polish law, subject to any mandatory provisions protecting consumers.

If any provision of these Terms and Conditions is found to be invalid or ineffective, this does not affect the validity of the remaining provisions.

Matters not regulated by these Terms and Conditions are governed by the applicable provisions of law.
